Well it's an unsubstantiated claim. People can say anything, it doesn't make it true.
The truth is this: the person with current full-time custody of the child(ren) is also ensuring they will have future custody of the child(ren). Family courts do not like changes in the status quo. That is why it's the initiator of divorce who always has custody of the child(ren), unless he or she doesn't want the kids. In any case, it's the initiator who has the element of surprise on his or her side. If you want custody, don't tell your spouse you want a divorce until the children are stowed away in your parent's house. Call the police if your spouse attempts to see your kids. It's that simple.
I'd say that in a way, Japanese law isn't sexist as it arbitrarily sees the current custodian of the children as the suitable future custodian, whether that custodian is the mother or the father. However, it is incredibly unfair to both the child(ren) and the non-custodial parent.
With the vast majority of breadwinners being the father, the mother has a greater opportunity to both plan and execute an abduction, and that's why the majority of single parents in Japan are mothers, not fathers. |
